“Certified Pre Owned” Doesn’t Mean What You Think – Lehto’s Law Ep. 2.47

Many people think that buying a Certified Pre Owned car is a safer bet – legally – than buying a typical used car. While CPO cars often have better warranties than other used cars, they do not offer any better legal protections. Among other things, this means that you need to get the CPO car independently inspected and know that if it is defective after purchase, the lemon law will probably not cover it.     I have purchased CPO cars and dealers have tried make me to sign as-is form. I have always refused to sign and they have sold the cars to me.

    How could I get a CPO Truck inspected by an independent mechanic before purchasing it first.

    In my experience I bought a Toyota CPO I found online and went to see it and bought it after reading all the benefits in included from Toyota. To be honest the salesperson did not even mention it was a cpo because they wanted to sell me an additional warranty which I did not accept. Definitely recommend it! Every CPO program is different so you must do your homework. For me Lexus has the best CPO program with unlimited miles for 6 years or so as well as many other perks. The warranty comes from the manufacturer not the dealer.

    I'm going thru this right now and it's a nightmare. I wish I did my homework. I bought a CPO 2015 Black Mustang and the paint was pretty turfed. Upon getting a quote for a paint correction my detail guy had pointed out that it had some body work done on the rear end/fender of the car. Now that he pointed it out and explained what to look for the bondo looks terrible! This also leads me to believe that it had been in some sort of accident but had a clean Carfax which obviously means nothing. Right now I am waiting to hear back from the dealership to hear if they will do anything. So bummed.

    I never trusted the term Certified Used due to the fact it is inspected by the same Dealer that use to call them Quality Used Vehicles! If the vehicle is not inspected by an outside agency what gives them the right to say Certified Used?

    This is like Me, Myself and I saying I am a 100% Certified Male Lover to all Women on All Planets…..except for Pluto! It only counts if She and or/or and or/and He……………this is 2017 one can never tell these days…………..gives you a Tripple AAA Auto Club, Military, AARP or Dinners Club Discount or takes EBT or Food Stamps…………do not discriminate against the Financially Disadvantage/Disabled Person……..or……….or…………or wait for it………….The Folks with Americans with Disabilities will be all up in your……………..I am Old School ….we will Just say Don't Ask Don't Tell! But I digress once again……….

    I once looked at a used car at a dealership, I mentioned taking the car to a mechanic for an inspection. The salesman said "We can have our mechanic do an independent inspection for you". I was stunned and told him YOUR mechanic can't do an INDEPENDENT inspection for me, he works for YOU. He replied "sure he can". I left without any further discussion.

    more truth then I have ever heard here. the Impala I had was purchased a couple of years before I purchased it as certified preowned. turns out it has been in an accident and it wasn't reported to Carfax and autocheck until I went to purchase it from the guy who purchased it cpo. the Mazda3 I bought was purchased certified preowned. so many issues with it – broken center console latch, bad fuse, dirty transmission fluid, filthy air filter. these stealerships just want your money. I'm done buying used cars from dealerships. while I won't drive my car into the ground, I'll be sure to take great care of it and get use out of it so I can get good money for it when I am ready to cash out. used cars in general are huge money makers for dealerships. it's almost like you are forced to buy private party or brand new

    I think you have missed part of what the dealer is doing here. the dealer is passing the risk and cost to the manufacturer of having to pay for a bad engine or trans etc. on cars that are traded in. If the dealer misses a major problem when a customer trades in a car. they have to repair the car, or send it to the auction and take beaten, or get the manufacturer to certify the car with a extended service plan that will cover the cost of the repairs. customers dont get to upset with problems as long as it doesnt cost them anything.

    I sold cars (feel free to hold that against me) in the DFW area back right when Expeditions had just come out (they were asking $3,000 OVER sticker for them when I started)

    the "Certified Preowned" had just come out and was gaining popularity as well……one day (probably a Monday after the all hands on deck sales meeting and when it was slow) they got all the salesmen together and said head over to the used car side

    we got over there and they just started handing us keys and pointing to cars and telling us "roll the windows up and down, check the locks, check if the tilt wheel works, jump in the car and spin it around the test drive route and look for any lights that might come on"

    as each car came back with no issues and you handed it back over they put the "certified preowned" info on the cars and that was that

    most of the guys just cranked up the AC and the radio and drove around a bit just to get off the lot not even paying attention to anything……so you were guaranteed the AC and radio and the drivers door worked for sure and that was about it

    the place was actually a reputable dealer overall though

    I was test driving a brand new car with ZERO miles on it in Johnson CIty Tn 15 years ago at one of its biggest dealerships . After putting about 1 mile on it while going up a steep hill the OIL LIGHT came on. I pulled over. The salesmen checked the oil. It was not put in by service crew. I thought he would call to have us picked up and the car towed back to dealership. He didn't. He told me to drive back. I gave him the keys and remembered thinking, I don't want to be the person buying this 'new' car.

    what happens if your buy a CPO with a clean titled with carfax then a few years later find out the car when you want to trade it in but find out it had an accident via Carfax. What should i do?

    Step 1. get VIN. Step 2. Get a Carfax. Step 3. get 2nd VIN history and cross reference with Carfax. Step 3. call dealership and let them know right away you are going to ask for INDEPENDENT mechanical inspection BEFORE you even show up at the dealership. If they refuse, walk away. If they say yes, get an inspection. Ask mechanic for estimate of repairs, if any. Then bargain down the price by the amount of repairs. Better yet, there are many websites that should give you prices paid for used cars given age and mileage. Bring that to your meeting with the salesman. I would not pay extra for warranty. Your warranty may have any number of hidden or illegible clauses in fine print which you will not have time to read and which may end up not covering certain damaged items.
